K.Narashimman v. Inspector Of Police
Crl.R.C.No.1284 of 2023 A.D.JAGADISH CHANDIRA, J.
The matter is placed before this Court on the letter dated 07.02.2024 received from the learned Chief Judicial Magistrate, Krishnagiri, seeking extension of time to complete the proceedings in Spl.C.C.No.1 of 2020 on the file of the Chief Judicial Magistrate Court, Krishnagiri.
2. It is seen that this Court, while disposing the revision case in Crl.R.C.No.1284 of 2023 on 25.07.2023 had directed the trial Court, to complete the trial in Spl.C.C.No.1 of 2020 within a period of five months from the date of receipt of copy of that order. However, now the learned Chief Judicial Magistrate, Krishnagiri, had sent a letter in Dis No.146/2024 dated 07.02.2024 seeking further time to complete the trial, stating that the case is pending for further examination of LW1 and LW5 to LW30.
3. Learned counsel for the petitioner/A1 submitted that the petitioner has cross examined PW1 and PW2 on the same day i.e. on 07.11.2023. He further submitted that due to paucity of time, cross examination of PW3 was done only in part on the same day and the matter was adjourned to 21.11.2023 for the
continuation of the cross. Since the respondent has not produced the witnesses, the case has been adjourned on several occasions.
4. Learned Government Advocate (Criminal Side) submitted that the respondent Police would take steps to produce the witnesses in a time bound manner as directed by the trial Court and the respondent would cooperate for the speedy disposal of the trial.
5. Considering the reasons and the requests made by the learned Chief Judicial Magistrate, Krishnagiri as well as by the learned Government Advocate (Criminal Side), this Court feels it appropriate to extend the time by six months.
6. Accordingly, the time for disposing the case in Spl.C.C.No.1 of 2020 on the file of the learned Chief Judicial Magistrate, Krishnagiri, is further extended by six months from today.
28.02.2024 Note to office:- The Chief Judicial Magistrate, Krishnagiri, may be apprised of the extension of time forthwith.
