ORDER

This Writ Petition has been filed seeking issuance of writ of mandamus, directing the 3rd respondent to receive and register the settlement deed dated 07.05.2026 (generated vide Temporary Application No.TP/ 270871635/ 2026) executed by the petitioner in favour of petitioners husband, Mr.P.Amirthalingam and to release the said document within a time-bound period as prescribed by this Honble court after completion of necessary registration formalities.

2. The learned counsel for the petitioner would submit that in this case, when a settlement deed 07.05.2026 was presented for registration with all required documents, the 3rd respondent refused to receive and register the same on the ground that the parent is an unregistered Will.

3. In reply, the learned Government Counsel appearing for the respondents would submit that once such document is re-presented before the respondent, the respondent will receive the same and pass appropriate orders to register the same, in accordance with law.

4. Heard the learned counsel for the petitioners and the learned Government Counsel for the respondents and also perused the materials available on record.

5. In view of the above, this Court directs the petitioner to re-present the settlement deed dated 07.05.2026 before the respondent within a period of two weeks from the date of receipt of a copy of this order. Once such document is re-presented by the petitioner, the 3rd respondent shall receive the same and thereafter, pass appropriate orders to register and release the same, in accordance with law, within a period eight weeks from the date of such representation of the settlement deed by the petitioner. It is needless to say that registration of the Will is not mandatory and the respondent cannot refuse registration of the settlement deed merely because the parent document is unregistered one.
