2. Heard the learned counsel for the petitioner/appellant and Mr.P.Suresh Srinivasan who has entered appearance on behalf of the 2nd respondent.
3. The learned counsel for the respondent has no objection for this petition being allowed.
4. Being satisfied with the reasons stated in the affidavit filed in support of the petition, this petition is allowed and the delay of 94 days in preferring the above appeal is condoned.
5. The Registry is directed to number the appeal and print the name of Mr.P.Suresh Srinivasan learned counsel for the 2nd respondent, when the matter is listed for admission.
