Civil Revision Petition filed under Article 227 of Constitution of India, to direct the learned Principal Subordinate Judge at Coimbatore to expeditiously complete the proceedings in O.S.No.1087 of 2019 within a stipulated time fixed by this Hon'ble Court. In both CRP's.:

For Petitioner : Mr.Aravind Subramanian, SC for Mr.V.Haribabu COMMON ORDER The petitioner seeks expeditious disposal of the suits in O.S.Nos.708 of 2023 and 1087 of 2019, both pending on the file of the learned Principal Subordinate Judge at Coimbatore.

2. In view of the limited relief sought for by the petitioner, notice to the respective respondents is dispensed with. Page No.2 of 5

Mr.Aravind Subramanian, the learned Senior counsel appearing for the petitioner submits that, the suits in O.S.No.1087 of 2019 and O.S.No.202 of 2020, subsequently renumbered as O.S.No.708 of 2023 are pending before the Principal Subordinate Court at Coimbatore. He would state that though trial has commenced, the respondents/defendants have taken out Interlocutory applications in the suit filed by the revision petitioner and therefore, the trial is getting deferred. Learned counsel further states that the parties are Senior citizens and they have come to Court seeking relief of declaration and permanent injunction and partition.

4. I have heard the learned counsel for the petitioner and I have also gone through the materials placed on record.

5. Considering that the trial has already commenced, the learned Principal Subordinate Judge, Coimbatore is directed to expedite the trial and in any event dispose of the said suits in O.S.No.1087 of 2019 & 708 of 2023 within a period of four (4) months from the date of Page No.3 of 5

receipt of a copy of this order, after affording opportunity of hearing to the parties.

5. Accordingly, these Civil Revision Petitions stand disposed of. No costs.
