ORDER

By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself.

2. This writ petition has been filed for a direction, directing the respondent to refund the total security deposit amount of Rs.7,55,456/- (Rupees Seven Lakhs Fifty-Five Thousand Four Hundred and fifty-six only) together with interest at 9 percent per annum from the date of vacation of the shop until the date of actual payment, to the petitioner

3. It is the case of the petitioner that the petitioner was the lawful allottee

of a shot situated in Anna Perunthu Nilayam Bus Stand vide auction on 23.03.2017. During the 9 years of tenancy, the petitioner has paid monthly rent and paid total security deposit of Rs.7,55,456/- and the respondent has also issued No Due Certificate confirming no outstanding dues. It is the grievance of the petitioner that though the petitioner has closed the shop and handed over possession, security deposit is not refunded. Hence, the petitioner made representations dated 09.03.2026 & 13.03.2026 which are pending without consideration till date. Hence, this writ petition.

4. Heard both sides and perused the materials placed on record.

5. Considering the facts and circumstances of the case, this Court without going into the merits of the case directs the respondent to consider the representations of the petitioner dated 09.03.2026 & 13.03.2026 and pass appropriate orders on merits and in accordance with law within a period of four weeks from the date of receipt of a copy of this Order.
