The Petitioner is A4 in C.C.No.36 of 1998 and was convicted alongwith other Accused by the trial Court. Against which the Petitioner had preferred an Appeal in Crl.A.No.370 of 2019. He had also filed suspension of sentence in Crl.MP.No.14078 of 2019 and this Court suspended the sentence of the Petitioner on 04.10.2019, with a direction to appear before the trial Court once in four months. Thereafter, the condition was modified as once in six months as per the order passed in Crl.MP.No.6871 of 2021 on 10.08.2021, finding that the Petitioner due to his old age and ailment was finding it difficult to appear before the trial Court. 2.The Petitioner is aged about 73 years. The present Petition has been filed along with Medical Certificate. It is seen from the Medical Certificate that the Petitioner is suffering from post rectal cancer with permanent colostomy with incisional hernia. He is also suffering from anxiety disorder and physical instability. In view of the same, the condition to appear before the trial Court is totally relaxed.
