Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus calling for the records relating to the Select List dated 07.03.2007 published by the first respondent in so far as the post of Faculty for Staff Training College in MMG Scale III (FFSTC) is concerned and quash the same and direct the first respondent to conduct a denovo selection for the 12 vacancies in the said post and appoint the petitioner to the post of Faculty For Staff Training College in MMG scale III on that basis with all consequential benefits.

O R D E R

The petitioner has filed this writ petition seeking issuance of Writ of Certiorarified Mandamus calling for the records relating to the Select List dated 07.03.2007 published by the first respondent in so far as the post of Faculty For Staff Training College in MMG Scale III (FFSTC) is concerned and quash the same and to direct the first respondent to conduct a denovo selection for the 12 vacancies in the said post and appoint the petitioner to the post of Faculty For Staff Training College in MMG scale III on that basis with all consequential benefits. 2.The case of the petitioner is that he is a physically challenged person suffering from orthopedic handicap and loco motor disability and he belongs to OBC category which is a reserved category. The petitioner was originally appointed as a Clerk in the Canara Bank on 14.12.1983.

Thereafter, he worked in various posts and during the time of filing this writ petition, the petitioner was working in the grade of Officer in Alagapuram Branch, Salem. 3.It is the further case of the petitioner that on 10.04.2006, the Bank invited applications for appointment by direct recruitment of Specialist Officer in various grades and the petitioner submitted application under the prescribed format to the second respondent (through the third respondent) for appointment to the post of FFSTC on 16.05.2006. The petitioner requested for issuance of experience certificate to the Senior Manager of the respondent Bank. Accordingly, a copy of the same was given to the petitioner wherein, the petitioner noticed that the Bank had erroneously showed the date of his promotion as Officer as 07.04.2003 instead of 16.10.2001.

Hence, the petitioner requested for revised experience certificate on 17.06.2006.

4.It is the further case of the petitioner that the respondents short-listed his name for interview and addressed a letter dated 05.12.2006 calling upon his to attend the interview and the petitioner also participated in the interview on 18.12.2006. However he was not selected. Aggrieved by the same, the petitioner has filed this writ petition.

5.This Court while entertaining the writ petition has not granted any interim order. In the absence of any interim order and after a lapse of nearly eleven years, I do not find anything survives in this writ petition for adjudication. 6.Accordingly, this writ petition is closed. However, this order will not stand in the way of the petitioner, if he had already obtained any promotion subsequently. No costs.

Consequently, the connected miscellaneous petition is also closed.
