The petitioner has filed the above Writ Petition to issue a Writ of Certiorarified Mandamus challenging the Marriage Certificate dated 21.08.2020 alleging that there was no marriage solemnized between the petitioner and the 3rd respondent.. https://hcservices.ecourts.gov.in/hcservices/
2. It is an admitted fact that the 3rd respondent had given a police complaint against the petitioner on 22.08.2020 stating that the petitioner is refusing to live with him. Thereafter, the petitioner has given a representation to the Sub Registrar on 23.09.2020 seeking for cancellation of the Marriage Certificate. On 11.12.2002, she has filed the Writ Petition seeking for the prayer sought for in the Writ Petition.
3. Since it is a matter for evidence, the same cannot be decided in the present Writ Petition under Article 226 of the Constitution. The remedy open to the petitioner is only to file a HMOP before the competent Civil Court/Family Court for annulment of the Marriage. In such view of the matter, I am not inclined to entertain the Writ Petition. Accordingly, the Writ Petition is dismissed. No costs. Consequently, the connected Miscellaneous Petition is closed.
