PRAYER : Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus to direct the respondents to impound the passport of the 3rd Respondent pending disposal of CC No.324 of 2007 on the file of the Judicial Magistrate-II, Hosur.

This writ petition has been filed seeking a direction to the first respondent to impound the passport of the third respondent.

2. According to the petitioner, the petitioner is the wife of the third respondent. A criminal case filed by the petitioner against the third respondent in C.C.No.324 of 2007 on the file of the Judicial Magistrate -II, Hosur, is pending. Since the third respondent is taking steps to abscond, and flee from the country, the petitioner sent a representation to the first respondent to impound the passport of the third respondent. But, no action has been taken so far, hence, the present writ petition has been filed.

3. The learned counsel appearing for the first respondent submits that already the validity of the third respondent's passport was expired on 31.03.2013 and the same has not been renewed thereafter.

4. Considering the above fact that since the passport of the third respondent has already been expired, nothing remains for adjudication in this writ petition.

5. Recording the above submission, this writ petition is closed. No costs.

Consequently, connected miscellaneous petition is closed.
