The only grievance of the appellant is that the Arbitral Tribunal has not heard the application filed by him for raising the attachment.
2. The counsel who has appeared for the respondent has no objection to the matter being remitted back to the Arbitral Tribunal for the Arbitrator to consider afresh the application moved by the appellant and arbitrate the disputes therein. Consequently, the delay in filing the Appeal is condoned and the Registry is directed to number the above Appeal.
3. The following order shall be incorporated in the Appeal: "The appeal is allowed and the matter is remitted back to the Sole Arbitrator for considering the application moved by the appellant for raising the attachment and passing order thereon within a period of one month from the date of receipt of a copy of this order or on the furnishing of a copy of the order."
