O R D E R

The petitioner herein, who is an accused in S.C.No.49 of 2012 on the file of the learned on the file of the learned Additional District and Sessions 1/4

Judge, Chengalpattu in Crime No.966 of 2009 for the offence under Sections 147, 148, 302 read with Section 149, 341, 201 read with Section 302 read with Section 201 of IPC.

2. Even after completion of investigation in the year 2012 and committed to the Court of Sessions, it could not be proceeded due to repeated absence of the accused and this petitioner is one among the seven accused and for 3 1/2 years remained absent and the respondent police has secured him only on 04.08.2022 after issuance of NBW . Now, for the eighth time, he has sought for bail. In all the previous occasions, this Court has considered the fact and dismissed the bail petition stating that if the petitioner is released on bail there will be further delay in trial.

3. The learned Government Advocate (Crl. Side) states that S.C.No.49 of 2012 is pending on the file of the learned Additional District and Sessions Judge, Chengalpattu for several years and only after securing the accused persons and detaining them in prison, the trial is progressing. He further submitted that, out of 21 witnesses, so far 17 witnesses have been examined and the remaining witnesses will be examined within two months. 2/4

4. This Court taking note of the conduct of the petitioner and the nature of the grave offence committed, this Court is not inclined to consider the bail petition of the petitioner.

5. Accordingly, this Criminal Original petition is dismissed. However, the trial Court is directed to expedite the trial within a reasonable time preferably within a period of two months.
