A.No.3125 of 2020 A.No.3125 of 2020 N.SATHISH KUMAR, J Instant application has been filed to grant leave to sue as against the properties which are situate outside the jurisdiction of this Court and morefully described in Schedule B Items III and IV and Schedule C Item 2 of the intending plaint.

2. Heard Mr.R.Thiagarajan, learned counsel for the applicant.

3. Learned counsel appearing for the applicant would submit that item Nos.1 and 2 in B Schedule and item No.1 in C Schedule situate within the jurisdiction of this Court. Apart from the above, some other properties are outside the jurisdiction of this Court. Since all the parties are residing in Chennai, leave is required to file a suit for partition. http://www.judis.nic.in

4. Having regard to the above aspects, particularly the suit is for partition, all the defendants are residing within the jurisdiction of this Court, this Court is of the considered view to grant leave to sue as against the properties which are situate outside the jurisdiction of this Court.

5. Accordingly, instant application is allowed and leave is granted. 17/12/2020 mvs.
