ORDER

This Criminal Original Petition is filed, aggrieved by the order dated 04.06.2025 in Criminal M.P. No. 1369 of 2025 in C.C. No. 03 of 2019 by the XI Additional Special Judge for CBI Cases, Chennai. 1/5

2. Heard the learned counsel appearing for the petitioner.

3. The learned counsel appearing on behalf of the petitioner would impugn the order in Criminal M.P. No. 1369 of 2025 only to the limited extent of modifying Condition No.7(b) that is, where the Trial Court has directed each of the two sureties to submit fixed deposit receipts for Rs.5 lakhs.

4. The learned Counsel appearing on behalf of the petitioner submits that there is some financial difficulty for the accused. There are 445 accused in this case, and only on account of the pendency of the discharge applications filed by various accused, the case is now pending. Only to the limited extent of providing of fixed deposit receipts (FDRs) for a sum of Rs.5 lakhs, a request is made that the same be reduced to Rs.2 lakhs each.

5. The learned Special Public Prosecutor appearing on behalf of the respondent would submit that the trial Court has given all the permissions and has duly imposed the conditions.

6. I have considered the rival submissions made on either side.

After considering the nature of the case, which is said to be a job racket wherein ineligible persons were given employment at various places in the bank, and against many of whom action has already been taken, and all those bribe-givers are also arrayed as accused, totaling 445 in number, I am of the view that the plea of the learned counsel for the petitioner, that there is financial difficulty on account of the petitioner's wife suffering from fourth stage cancer, can be considered.

8. Accordingly, this criminal Original Petition is allowed in part to the following extent:- (i) The order dated 04.06.2025 passed in Criminal M.P. No. 1369 of 2025 in C.C. No. 3 of 2019 by the XI Additional Special Judge for CBI Cases, Chennai, inasmuch as Paragraph 7(b) is modified to the following effect:- "The petitioner should produce two sureties, preferably from their family, and each surety shall submit original fixed deposit receipts (FDRs) for Rs. 2,00,000/- each."
