Common Prayer: Writ Petitions filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorari, calling for the records on the file of the first respondent leading to the impugned orders dated 18.05.2019 & 24.05.2019 in Na.Ka.11949/2019/M/1 and quash the same. 1/4

R.Meenal in both WPs COMMON ORDER These writ petitions are filed challenging the orders passed by the first respondent issuing certain directions relating to the conduct of sixth day function in the annual Brahmotsavam.

A reading of the impugned order would make it clear that certain directions were issued by the first respondent based on the peace committee meeting held for conduct of Brahmotsavam in the year 2019. The Bhramotsavam function is already over. Therefore, the correctness of the order passed by the first respondent need not be gone into by this Court at this stage. Even in the order passed by the first respondent on 18.05.2019 and 24.05.2019, it is clearly stated that each year sixth day function of the Brahmotsavam shall be conducted as per custom without causing any law and order problem, subject to orders passed from time to time. 2/4
3. In view of the above said facts, the correctness of the impugned order need not be gone into at this stage as the function is already over. It is also made clear that the sixth day Brahmotsavam function shall be conducted by following the custom and usage and any dispute thereof can only be decided by jurisdictional joint commissioner based on the application filed by the respective parties. Therefore, if any dispute arises regarding the manner in which the sixth day Brahmotsavam function is to be conducted, the petitioner, the fourth respondent or any other interested party are at liberty to approach the jurisdictional Joint Commissioner seeking necessary orders.
4. With these clarifications, these writ petitions are disposed of. No Costs. Consequently, connected miscellaneous petitions are closed. 12.11.2024 Index : Yes/No Internet : Yes/No Speaking Order/Non-Speaking Order av 3/4
