Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus, directing the respondents not to install
high voltage (HT) lines in the streets of Mookambigai Nagar, Lakshmi Nagar and Sri Balaji Nagar of Achariyapuram, Villianur, Puducherry as the same is in violation of Rule 80 of the Indian Electricity Rules, 1956 and further direct the respondents to lay the High Voltage (HT) Lines under the ground as done in the urban areas of Puducherry. ORDER
(Made by the Hon'ble Chief Justice) Heard Mr.E.Thiyaga, learned counsel for the petitioner and Mr.S.Raveekumar, learned Government Pleader (Puducherry) for the respondents.
2. Learned counsel for the petitioner submits that the respondents are intending to install high-voltage lines in the streets of Mookambigai Nagar, Lakshmi Nagar and Sri Balaji Nagar of Achariyapuram, Villianur, Puducherry, in violation of Rule 18 of the Indian Electricity Rules, 1956. The petitioner further seeks a direction against the respondents to lay high-voltage lines under the ground, as done in the urban areas of Puducherry.
3. Learned Government Pleader (Puducherry) submits that the respondents, while laying the high-voltage lines, would follow the Rules and Regulations in force.
4. The high-voltage lines are not yet laid. It appears that the petition is filed merely on apprehension. The respondents certainly will have to follow the Rules and Regulations, in force, while installing the high-voltage lines.
5. In case the respondents deviate from the Rules and Regulations in force, then the petitioner may agitate against the same.
6. With these observations, the writ petition stands disposed of. There will be no order as to costs. Consequently, W.M.P.No.25552 of 2023 is closed.
