Civil Suit has been filed under Order VII Rule 1 of C.P.C. read with Order IV Rule 1 of O.S.Rules praying to pass a judgment and decree for:- (a) permanent injunction restraining the defendant or her relatives or men or agent/s or anybody claiming under or through her on behalf of the defendant from in any way whatsoever interfere with the plaintiffs' peaceful possession and enjoyment of the suit schedule property in any 1/5

manner.

(b) permanent injunction restraining the defendant or her relatives or men or agents or anybody claiming under or through her from encroaching upon the suit schedule property belonging to the 1st plaintiff by putting up any construction in the suit schedule property. (c) direct the defendant to pay the costs of the suit. For Plaintiffs :

J U D G M E N T

Ms.R.Maheswari, learned counsel for the plaintiffs, Mr.S.Malarmannan, learned counsel for the defendant, plaintiffs and defendant are present before this Court.

2. Both the aforementioned learned counsel submit that the plaintiffs and defendant have settled the matter and have reduced the terms of settlement into a 'Joint Memorandum of Compromise dated 07.08.2024' ['said JMOC']. The said JMOC has been signed by both parties and their respective counsel.

3. Both the learned counsel, on instructions, submit that the parties would abide by the terms of the said JMOC and request for the suit to be decreed in terms of said JMOC.

4. In view of the above, said JMOC is taken on record and the Civil Suit is decreed in terms of said JMOC which shall form part of judgment and decree. Registry is directed to refund necessary Court fee to the plaintiffs as per Rules. Consequently, connected application is closed.
