ORDER

This Writ Petition has been filed for direction directing the second respondent to forward the family pensions proposal submitted by the petitioner on 26.12.2023 without any further delay and in case it is being received by the first respondent on receipt of this to grant the family pension to the petitioner within the time frame to be fixed by this Hon'ble Court.

2. Heard the learned counsel on either side and perused the materials available on record.

3. The petitioner's father worked as Sub Inspector in Tamil Nadu Special Police, III Battalion, Avadi, Chennai. He had retired from service due to his attainment of superannuation, on 31.03.1986. Thereafter, he was receiving pension and died on 27.01.1994. The petitioner is one of the daughters. She got married to one Avudaiappan and lived together.

While being so, her husband died on 31.01.2017. After the demise of her husband, now the petitioner sought for family pension, on the demise of her father under the category of widowed daughter.

4. The petitioner's father pre-deceased to her husband. In fact, her husband died only on 31.01.2017. Therefore, the request made by the petitioner seeking family pension cannot be considered and the writ petition is devoid of merits and is liable to be dismissed.
