This writ petition has been filed challenging the proceedings of the first respondent dated 27.06.2023 wherein the first respondent has proceeded to cancel the document writer license issued to the petitioner. 2.Heard M/s.A.Pramila, learned counsel for the petitioner and Mr.Stalin Abhimanyu, learned Additional Government Pleader for the first respondent and perused the materials placed on record, apart from the pleadings of the parties.

On carefully going through the impugned proceedings of the first respondent, it is seen that the cause of action for initiating the proceeding was as a result of a demonstration that was planned to be conducted by the document writers against the conduct of some of the officials belonging to the Registration Department. It is also seen that the office bearers of the coordination committee have been chosen and their licenses have been cancelled.
4. The short question that arises for consideration is as to whether such demonstration proposed to be conducted by the document writers could be a ground to cancel their license.

5. The Tamil Nadu Document Writers' License Rules, 1982, deals with the scenario where such licence can be cancelled. Only where there is a professional misconduct or there is a violation of conditions of the document writers, such cancellation of license can take place. In the case on hand, only permission was sought for conducting the demonstration and ultimately, no demonstration took place and even then, the document writer license that was issued to the petitioner came to be cancelled. The very reason for which license has been cancelled goes against the fundamental rights that has been guaranteed under Article 19(1)-A of the Constitution of India under.
6. The impugned proceedings of the first respondent dated 27.06.2023 is illegal on the face of it and it is liable to be quashed.
7. In the result, the proceedings of the first respondent is quashed and this writ petition stands allowed. No costs. Consequently, connected miscellaneous petition is closed.
