The Transfer Civil Miscellaneous Petition has been filed by the petitioner/wife seeking transfer of petition for divorce filed by the respondent/husband in I.D.O.P.No.155 of 2022 on the file of the District Judge - II, Kanchipuram to the file of the Nilgiris District Court at Ooty.

2. Heard the arguments of the learned counsel for the petitioner and the learned counsel for the respondent.

The petitioner herein seeks transfer on the ground that she is residing at her parental home at Coonoor, Nilgiris District and she finds it very difficult to undertake such a long travel to Kanchipuram for the purpose of attending court hearings. Therefore, she filed this transfer petition with the aforesaid prayer.

4. The learned counsel appearing for the respondent/husband filed counter and opposed the transfer application on the ground that the petitioner/wife is working as a regular employee in a IT Company called EQUINITI at Chennai. The respondent/husband is also working in the very 2/6

same company and he used to meet the petitioner/wife on all working days. When the petitioner is very well available in Chennai in connection with her work, the transfer application filed by her, as if she finds it very difficult to undertake travel to Kanchepuram is untenable.

5. The learned counsel appearing for the petitioner fairly submits that though the petitioner/wife was given permission to work from home, she used to visit Chennai two or three days per week for the purpose of attending the work physically.

6. In such circumstances, the petition filed by the respondent/husband may be transferred to Family Court, Chennai, so that it will be convenient for both the parties.

7. The learned counsel for the respondent has no serious objection for transferring the original petition to the file of Family Court, Chennai.

8. The learned counsel appearing for the respondent informs this 3/6

Court that as on today, I.D.O.P.No.155 of 2022 is pending on the file of the Principal District Court, Kanchipuram and the matter may be withdrawn from the file of Principal District Court, Kanchipuram and transferred to the file of Family Court, Chennai.

9. Since both the petitioner and respondent are working at Chennai, taking into consideration the convenience of both the parties, the petition in I.D.O.P.No.155 of 2022 pending on the file of Principal District Court, Kanchipuram is withdrawn and transferred to the file of Family Court, Chennai, for hearing.

10. Accordingly, the Transfer Civil Miscellaneous Petition is ordered. No costs. Consequently, the connected civil miscellaneous petition is closed.
