The petitioners, who apprehend arrest at the hands of the respondents police for alleged offences punishable under Sections 406, 420 r/w 34 of IPC, in crime No.694 of 2016 on the file of the second respondent, seek anticipatory bail.
2. The case of the prosecution is that the petitioners borrowed Rs.20,00,000/- from the defacto complainant. When the same was demanded, the petitioners issued a bank cheque. However, when it was presented, the same was dishonoured due to insufficient fund.
3. The learned counsel for the petitioners would submit that false complaint has been given against the petitioners and they have nothing to do with the said allegations. He further submitted that Interstate Anticipatory bail may be granted to them to enable them to move the appropriate jurisdictional Court in Kerala for necessary relief.
4. Taking into consideration the facts and circumstances of the case, this Court is inclined to grant inter-state interim anticipatory bail to the
petitioners for a period of six weeks from today to enable them to move the concerned Court.
5. Accordingly, interim interstate anticipatory bail is granted to the petitioners for a period of six weeks, on condition that the petitioners shall surrender before the learned Judicial Magistrate Court No.IV, Pondicherry within a period of fifteen days from the date on which the order copy made ready and each of the petitioners shall execute a separate bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the said learned Magistrate. Further, within four weeks from the date of execution of bail bond, the petitioners shall approach the competent Court in Kerala and seek appropriate relief.
