Respondent Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a writ of mandamus directing the respondent to consider and pass orders on my representation dated 06.07.2019, against the 'F' Order dated 10.01.2019, passed by the Joint Commissioner of Police, West Zone, Chennai, and seeking consideration for due promotion as Deputy Superintendent of Police, within a time-frame, as may be fixed by this Hon'ble Court and pass such further or other orders.

O R D E R

The petitioner filed the Writ Petition seeking to consider and pass orders on his representation dated 06.07.2019, against the 'F' Order dated 10.01.2019, passed by the Joint Commissioner of Police, West Zone, Chennai, and seeking consideration for due promotion as Deputy Superintendent of Police, within a time-frame.

2. The case of the petitioner is that the petitioner was appointed as Sub-Inspector of Police in the year 1997 and promoted as Inspector of Police on 10.07.2007. He had served as the Inspector of Police in P4 Basin Bridge Police Station, Chennai. Subsequently, he was transferred to Thirumullaivoyal Police Station. He was eligible to be considered for promotion to the post of Deputy Superintendent of Police, in the promotion panel 2018-19. While so, on 13.10.2018, a Show Cause Notice was issued by the Joint Commissioner of Police, West Zone, Chennai alleging lapse on his part to take action against certain persons. Although the petitioner had given his explanation dated 15.11.2018 rebutting the charges, the Joint Commissioner had passed the final order dated 23.01.

2019, imposing the punishment of "Postponement of his next Increment for a period of one year without cumulative effect". As against the said order, he preferred an Appeal. Thereafter, he had sent a representation dated 16.05.2019 to the Director General of Police, Tamil Nadu to consider his promotion. However, till date no order is passed, hence the present Writ Petition is filed.

3. The learned counsel for the petitioner would submit that it would be suffice to issue direction the the first respondent to pass orders on review application dated 06.07.2019 on merits and in accordance with law within a reasonable time.

4. Without expressing any opinion on the merits of the case and considering the limited request made by the learned counsel for the petitioner, I am inclined to issue direction to the first respondent to pass orders on Review application dated 06.07.2019 filed by the petitioner and pass orders on merits and in accordance with law within a period of twelve (12) weeks from the date of receipt of a copy of this order. With the above direction, the Writ Petition is disposed of. The petitioner to produce order copy for ready reference. No costs.
