The 5th and 7th defendants have been filed this application seeking to set aside the ex-parte order dated 02.03.2022 against them.
2. In the affidavit filed, it had been stated that the suit summons had been served and the present applicant had the taken responsibility of instructing the counsel and submitting necessary records. However, the other defendants also had to authorize to contest the case and there was a delay.
3. At any rate, since only an ex-parte order had been passed and it would always be to the advantage of all the parties that the suit is decided on merits, the ex-parte order is set aside.
4. The application stands allowed.
5. List the matter again, along with the written statement or application filed seeking to condone the delay of filing written statement on 19.10.2022.
