These writ petitions are filed under Article 226 of the Constitution of India, seeking writ of mandamus directing the respondent to pay the arrears of difference in Gratuity, arrears of difference in Earned Leave Salary and to pay arrears of difference in wages, from 01.09.2023 to the date of petitioners' retirement as per the 12(3) settlement as admitted by the respondent in their RTI reply together with interest at the rate of 12 percentage per annum.

2. Heard the learned counsel appearing on either side and perused the materials available on record.
3. The petitioners joined the service of the respondent corporation as Driver on 24.10.1986 and 26.03.2000, respectively and retired from service on 31.10.2019 and 31.03.2025, respectively. Subsequently, Section 12 (3) settlement as entered into between the Management and the Trade Unions, pursuant to which the wages and pension were also revised with effect from 01.09.2019 / 01.09.2023. Since the petitioners had retired
on 31.10.2019 and 31.03.2025, respectively, they are entitled to the difference in leave salary, gratuity and difference in wages as per the 12
(3) settlement. Accordingly, the petitioners submitted representations seeking the difference in leave salary, gratuity and difference in wages as per the 12 (3) settlement. However, the said representations have not been considered so far. Therefore, the petitioners are before this Court.
4. In view of the above, the respondent is directed to pay the applicable differential amount of gratuity, leave salary and pension arrears as per 12 (3) settlement, together with interest at the rate of 6% per annum, within a period of twelve weeks from the date of receipt of a copy of this order.
5.With the above direction, these Writ Petitions stands disposed of. No costs.
