Respondents Prayer :- Writ Petition is filed under Article 226 of the Constitution of India praying to issue a writ of mandamus directing the respondents 4 to 6 to cancel the patta No.7138 issued in the name of the seventh respondent in respect of house site property to an extent of 2400 sq.ft. together with buildings, comprised in No.56/1 situated at No.79, 2nd Main Road, Royala Nagar, Ramapuram, Maduravoyal Taluk, Chennai-89 by considering the representation of the petitioner dated 26.08.2021
For Petitioner in both WP's : Mr.L.Pachaiyappan for Mr.A.Ramalingam For Respondents in both WP's For R1 to 6 : Mr.Yogesh Kannadasan, Special Government Pleader COMMON ORDER The writ petition in WP.No.24067 of 2021 has been filed for direction directing the respondents 1 to 3 to cancel the settlement deed dated 15.10.2020 registered in document No.1686/2020 at Office of the Joint Sub Registrar-II, the third respondent herein in respect of house site property to an extent of 2400 sq.ft. together with buildings, comprised in S.No.56/1 situated at No.79, 2nd Main Road, Royala Nagar, Ramapuram, Maduravoyal Taluk, Chennai-89 which was executed by the seventh respondent in favour of the eighth respondent.
2. In this regard, the petitioner lodged complaint before the respondents 1 to 3 herein, but of no avail. Considering the said fact, the second respondent is directed to consider the complaint lodged by the petitioner in respect of fraudulent settlement deed executed by the seventh respondent herein in favour of the eighth respondent and, after issuance of notice to the petitioner and the respondents 7 & 8 and giving them opportunity of hearing, pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of copy of this order.

Insofar as the writ petition in WP.No.24070 of 2021, if the petitioner succeeds before the second respondent on his complaint, the fifth respondent is directed to conduct enquiry after issuance of notice to the parties concerned and pass orders on merits and in accordance with law in respect of cancellation of patta No.7138 stood in the name of the seventh respondent in respect of the house site property to an extent of 2400 sq.ft. together with buildings, comprised in No.56/1 situated at No.79, 2nd Main Road, Royala Nagar, Ramapuram, Maduravoyal Taluk, Chennai-89 within a period of six weeks thereafter.
4. With the above directions, both the writ petitions are disposed of. Consequently, connected miscellaneous petition is closed. No order as to costs.
