The petitioners, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 6(4) of TN SC (RDCS) Order, 1982 r/w Section 7(1)(a) (ii) of Essential Commodities Act, 1955, in Crime No.154 of 2022, seek anticipatory bail.

2. There are totally three accused in this case, in which the petitioners are arrayed as A2, A4 and A5. The case of the prosecution is that the petitioners along with other accused was found in illegal transportation of 16 tonnes of PDS rice.

3. The learned counsel for the petitioners submitted that the petitioners are innocent persons and no way connected with the alleged offence and they have been been falsely implicated in this case. Hence he prays to grant anticipatory bail to the petitioners.

4. The learned Additional Public Prosecutor appearing for the respondent submitted that the petitioner was found in possession of huge quantity of PDS Rice and if the petitioners are granted anticipatory bail, there https://www.mhc.tn.gov.in/judis

Anu is a possibility that he will tamper the witnesses and hamper the investigation. Hence, he vehemently opposed to grant anticipatory bail to the petitioners. 5.Considering the fact that the petitioners were involved in illegal possession of huge quantity of PDS Rice, custodial interrogation of the petitioners is very much required in this case. Hence, this Court is not inclined to grant anticipatory bail to the petitioners.
