Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the first and second respondents to approve the petitioner's appointment as Gardener in the third respondent College in the sanctioned vacancy caused by the Death of Mr.T.Pathinathan with effect from 04.06.2018 in the light of the approval given by the Joint Director of Collegiate Education to the similarly placed persons vide proceedings Pa.Mu.No.4874/A2/2013 dated 28.08.2019 in W.P.(MD). No.1234 of 2014 dated 24.02.2015 in W.A.(MD).No.931 of 2018 dated 12.07.2018 and in Special Leave Petition SLP.No.323 of 2019 dated 18.01.2019 with monetary and all other attendant and service benefits based on the representation given by the petitioner dated 05.01.2021.

ORDER

Mr.L.S.M.Hasan Fizal, learned Government Advocate takes notice on behalf of the first and second respondents and submits that appropriate orders will be passed in the light of the decisions rendered in W.P.(MD).No.1234 of 2014 dated 24.02.2015 in W.A.(MD).No.931 of 2018 dated 12.07.2018 and in Special Leave Petition SLP.No.323 of 2019 dated 18.01.2019.

2. Recording the submissions made by the learned Government Advocate for the first and second respondents, this writ petition is disposed by directing the second respondent to consider the representation dated 05.01.2021 of the petitioner and pass appropriate orders in the light of the aforesaid decisions of this Courts within a period of three months from the date of receipt of a copy of this order.
