In a proposed suit for recovery of money from the defendant, the intending plaintiff has presented this application seeking leave to sue. The plaintiff asserts that the defendant carries on business within the jurisdiction of this Court but resides outside the territorial limits of this Court. By adverting to the undertaking provided by the defendant to refund money received from the plaintiff, it is stated that such undertaking was given from Anna Nagar, Chennai.

2. Upon examining the affidavit and the draft plaint, it is evident that the cause of action has arisen at least partly within the jurisdiction of this Court. Accordingly, this application is allowed by granting leave to the applicant to institute the suit against the respondent before this Court. Consequently, the Registry is directed to number the suit, if it is otherwise in order.
