Writ petition filed under Article 226 of Constitution of India for issuance of a writ or order or orders or direction particularly in the nature of Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned order bearing No.10680/Tha.Ku-3/2025 dated 02.09.2025 passed by the 2nd Respondent and quash the same, and consequently direct the respondents to grant 40 days Ordinary Leave without escort to the convict prisoner,

Chinnadurai, aged 40 years, S/o. Subramani, Convict Prisoner, PID NO.3205, confined at Central Prison, Coimbatore, without insisting upon furnishing of a relative surety bond, in view of the fact that the Convict Prisoner has no surviving close relatives except his sister and she is unable to furnish such bond, and pass such further or other orders as this Honourable Court. Mr.M.M.I.Khaleel Government Advocate (Criminal Side) Order (Order of the Court was made by Sunder Mohan J.) The petitioner who is a life convict has challenged the impugned order dated 02.09.2025 which is a communication sent by the Superintendent of Central Prison, Coimbatore to the Tahsildar, Kothagiri Taluk, Nilgiris District requesting Tahsildar to issue notice to the convict's relatives for execution of sureties on behalf of the petitioner.

2. It appears that the petitioner's request for Ordinary Leave was considered favourably and an order was passed on 26.08.2025 by the Superintendent of Prison. The said order neither stipulates an escort nor requires blood relatives as sureties. The writ petition has been filed on the premise that the Tahsildar would insist on blood relatives as sureties.

3. The learned Government Advocate (Criminal Side) appearing for the respondents however on instructions would submit that, they would not insist on

blood relatives as sureties as that is not a condition on which the leave was granted to the petitioner.

4. At this stage, the learned counsel for the petitioner prayed that the petitioner may be permitted to offer sureties before the Superintendent of Prison.

5. In the facts and circumstances of the case, we are of the view that that the said request can be acceded to.

6. Accordingly the petitioner is permitted to produce sureties before the Superintendent of Prison instead of the Tahsildar.

7. With the above directions, this Writ Petition is disposed of. No costs. Connected Miscellaneous Petition is closed.
