Mr.N.Palanivel, Government Advocate (Crl. Side) Order The petitioner apprehends arrest for the alleged offence under Sections 120B, 420, 465, 468, 471 of Indian Penal Code and 82(d) Registration Act in Crime No.114 of 2025, on the file of the respondent police seeks anticipatory bail.

The allegation against the petitioner is that a joint patta bearing No.78 for an extent of 1,463 sq.ft. at Ulagampadi Village stood in the names of Sheik Bashi, father of the defacto complainant and Kathar Hussein. After the death of Sheik Bashi on 16.10.2021, the defacto complainant came to know that the legal heirs of Kathar Hussein had created a forged relinquishment deed dated 20.03.2017 in Doc.No.290/2017 on the file of the Vadaponparappi Sub Registrar Office and alienated the property to various parties. It is further alleged that the petitioner herein purchased a portion of the property under Doc.No.2243/2021 in connivance with the co-accused. Hence, the case.

3. The learned counsel for the petitioner submits that the petitioner is an innocent and has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court and ready to co-operate with the investigation. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that the petitioner is having four previous cases of similar in nature. Hence, he vehemently opposed the grant of anticipatory bail to the petitioner.

5. Considering the totality circumstances of the case and on the fact that, the petitioner herein is alleged to have forged documents, relating to the property of others. It seems that he is an habitual offender and on the further fact that the petitioner is having four previous cases of similar in nature, hence, this Court is not inclined to grant anticipatory bail to the petitioner.
