ORDER

The petitioner apprehends arrest for the alleged offence under Sections 341, 294(b), 323, 355 and 506(1) of Indian Penal Code, 1860 in Crime No.185 of 2026 on the file of the respondent police seeks anticipatory bail. 2.The case of the prosecution is that the defacto complainant alleged that on account of a pathway dispute, the petitioners obstructed the passage, abused

the defacto complainant and his relatives in filthy language, assaulted them and issued threats. Hence the case.

3. The learned counsel appearing for the petitioners submitted that the allegations are false and arise out of a civil dispute between the parties. It is further submitted that all the offences alleged against the petitioners are bailable in nature. The learned counsel would also submit that the petitioners are ready and willing to cooperate with the investigation. Therefore, he prayed to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent fairly submitted that all the offences alleged against the petitioners are bailable in nature.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. This Court is of the view that the offences alleged against the petitioners are admittedly bailable offences. Once the offences are bailable, the right of the accused to seek bail is protected under law and an application for anticipatory bail is not maintainable.
