O R D E R

(The case has been heard through video conference) Petitioner, who was arrested and remanded to judicial custody on 13.10.2020 for the offence punishable under Sections 294(b), 341, 392, 336, 506(ii) and 307 IPC in Crime No.3431 of 2020, seeks bail.

2. The petitioner is the sole accused. The case of the prosecution is that the petitioner is said to have waylaid the defaacto complainant, attacked him with knife and robbed a sum of Rs.300/-. Hence, a case has been registered against the petitioner.

3. The learned counsel for the petitioner would submit that the petitioner has been falsely implicated in this case with ulterior motive and he has nothing to do with the offence. Hence, he seeks bail to the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner is a habitual offender and he is having 5 previous cases, out of which, two cases are to https://hcservices.ecourts.gov.in/hcservices/

Section 302 IPC. Hence, she vehemently opposed to grant bail to the petitioner.

5. Considering the said facts and circumstances of the case and considering the bad antecedent of the petitioner, this Court is not inclined to grant bail to the petitioner and this Criminal Original Petition is dismissed accordingly.
