Writ Petition filed under Article 226 of the Constitution of India, praying to issue a writ of Mandamus, direct the 1 to 5 respondents to determine compensation payable to the petitioner in respect of the aforementioned acquired lands at Thiruvallur District, Gummidipoondi Taluk, Papangkuppam Village, Patta No. 2963, Survey No. 298/14A measuring an extent of Hectare 049.50 Ares of Agriculture land, 298/14B measuring an extent of Hectare 0-02.50 Ares of Agriculture land ,298/15B measuring an extent of Hectare 0-09.50 Ares of Agriculture land, 298/17A2 patta No. 2886 Measuring an extent of Hectare 003.00 ares of agriculture land in accordance with right to fair compensation and transparency in land acquisition, rehabilitation and resettlement act 2013 or any other equivalent or appropriate act and pay the compensation in tune with market value with solatium, interest, betterment charges etc., For Petitioner(s):

ORDER

This writ petition has been filed to direct the respondent to consider the petitioner's representations dated 06.04.2023, 12.04.2023 & 03.07.2023.

2. The learned counsel for the petitioner would submit that in this case, the representations were filed by the petitioner to determine compensation payable to the petitioner in respect of the aforementioned acquired lands at Thiruvallur District, Gummidipoondi Taluk, Papangkuppam Village, Patta No. 2963, Survey No. 298/14A measuring an extent of Hectare 0-49.50 Ares of Agriculture land, 298/14B measuring an extent of Hectare 0-02.50 Ares of Agriculture land ,298/15B measuring an extent of Hectare 0-09.50 Ares of Agriculture land, 298/17A2 patta No. 2886 Measuring an extent of Hectare 003.00 ares of agriculture land in accordance with right to fair compensation and transparency in land acquisition, rehabilitation and resettlement act 2013 or any other equivalent or appropriate act and pay the compensation in tune with market value with solatium, interest, betterment charges etc. However, the said representations were not at all considered by the respondent till date. Hence, this petition.

3. In reply, the learned counsel for the respondent would submit that the petitioner's representation will be disposed of by the 3rd respondent within a period of 12 weeks.

4. Heard the learned counsel appearing for the petitioner and the respondent and also perused the entire materials available on record.

5. In view of the above, without expressing any opinion on the merits of the matter, this Court directs the respondent to consider the representations of the petitioner dated 06.04.2023, 12.04.2023 & 03.07.2023 and dispose of the same, on merits and in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order.
