The matter was disposed of on 09.10.2025 and based on the mentioning made by the learned counsel for the petitioner, the case is listed for hearing today for clarification.

The learned counsel for the petitioner submitted that the earlier charge sheet that was filed containing offences under POCSO Act was subsequently withdrawn and the name of the petitioner was dropped from the charge sheet. But the petitioner is shown as a witness in the supplementary charge sheet, and the earlier charges against the petitioner for POCSO offences is now staring at the petitioner and that is causing prejudice to the petitioner. If that is so, any authority or Court dealing with any of the other cases involving the petitioner, the earlier charge sheet cannot be put against the petitioner and it has to be considered on its own merits.

3. The above clarification will sufficiently take care of the interest of the petitioner.

4. Registry is directed to incorporate the above paragraph No.2, in the earlier order dated 09.10.2025 and issue a fresh order copy to the petitioner.
