ORDER

This Writ Petition has been filed to direct the first respondent to consider the petitioner's complaint dated 25.06.2023 and take action against second and third respondents within the time frame fixed by this Court.

The case of the petitioner is that there is matrimonial dispute between the petitioner and his wife and on the basis of the complaint given by the wife of the petitioner, second and third respondents broke open the house of the petitioner and took away all the articles. Hence, seeks a direction to the first respondent to take action against the second and third respondents.

3. A perusal of the representation of the petitioner itself shows that the wife of the petitioner along second respondent had taken her articles. Therefore, this Court is of the view that merely on the basis of a matrimonial dispute, a direction to take disciplinary action action against the second and third respondents cannot be given. If at all, the petitioner has any grievance, he has to pursue his remedy as per law by filing a private complaint before Court. Hence, I do not find any merits in this Writ Petition.

4. Accordingly, this Writ Petition is dismissed. No costs. 02.08.2023 Index:Yes/No vrc 3/5
