Respondents Prayer Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus to call for records of the 2nd Respondent ending in Final Assessment Notice No.10/20-21/228581 dated 15/10/2020 in respect of the petitioner's 1/4

premises at No.290 Rajiv Gandhi Salai, Sholinganallur, Chennai- 600119 and quash the same and consequently, direct the respondents to refund the excess property Tax Amount of Rs.2,41,02,394/- (Rupees Two Crores Forty One Lakhs Two Thousand Three Hundred and Ninety Four Only) collected by the Respondents from the petitioner.

For Petitioner : No appearance For Respondents : M/s.K.Aswini Devi Standing Counsel Order When the matter is taken up for hearing, none appeared on behalf of the petitioner. Whereas, the learned Standing Counsel for the respondents appeared and submitted that the entire amount has been paid by the petitioner and there is no due, that is required to payable by the petitioner for the particular Assessment Year, and therefore, nothing survives for adjudication in this Writ Petition. However, when the matter is taken up for hearing today, none appeared for the petitioner. That apart, it is seen from the Docket Sheet of this Writ Petition that the matter has been adjourned to very many occasions and nearly, for four occasions, the matter was adjourned due to non-appearance of the petitioner, this Court is not inclined to adjourn the matter for want of appearance of the petitioner. Writ Petition is dismissed for non-prosecution. No costs. Consequently, connected Miscellaneous Petition is closed.
