3.Ms. Naseera Banu, learned counsel appearing for Mr.MA.P.Thangavel, for the 1st respondent does not have any serious objection in allowing the petition.

4. Despite serving of notice and his name being printed in the cause list, the 2nd respondent, neither present before this court, nor appeared though his counsel.

5. Being satisfied with the reasons stated in the affidavit filed in support of this petition, this Civil Miscellaneous Petition is ordered and the delay of 107 days in filing the above appeal is hereby condoned.
