2. This writ petition has been filed for the issue of a Writ of Mandamus to consider the on-line application dated 17.09.2021 wherein the petitioner has sought for a new service connection in the subject property.
3. The case of the petitioner is that he is a tenant in the property. The service connection that was available in the property was disconnected since the erstwhile tenant did not pay the current consumption charges. Thereafter, the petitioner became a tenant in the property and he had paid the necessary caution deposit and had sought for new service connection. According to the petitioner, he has also obtained the No Objection Certificate from the landlord. Since the on-line application was not considered, the present writ petition has been filed before this Court seeking for appropriate directions.
4. The learned Standing Counsel appearing on behalf of the respondents, based on the written instructions, submitted that the petitioner must submit the relevant documents to prove his possession in the property and must also get the No Objection Certificate. That apart, if there are any arrears of amount payable towards current consumption charges, the same should also be settled and thereafter the respondents will process the application submitted by the petitioner.
5. Taking into consideration the facts and circumstances of the case and the submissions made by the learned Standing Counsel appearing on behalf of the respondents, there shall be a direction to the petitioner to submit the relevant documents to prove his possession in the property along with the necessary No Objection Certificate. That apart, if there are any arrears of amount payable towards current consumption charges, the same shall also be settled by the petitioner. Immediately thereafter, the fourth respondent shall process the on-line application submitted by the petitioner and provide the service connection within a period of two weeks thereafter.
