This petition is filed by a third party to the appeal seeking to implead himself as Legal Heirs of Vadivel, who was arrayed as third defendant in the suit. The present first appeal had been filed by the sons of the said Vadivel, who were arrayed as defendants 8 & 9 in the suit. As per the affidavit filed in support of the application, the third defendant Vadivel died on 14.05.2022, subsequent to passing of judgment in the original suit. Therefore, this Court is inclined to order this application as prayed for.

2. The learned counsel for the petitioner made an endorsement in the present petition filed under Order 1 Rule 10 of CPC that it can be treated as a petition to bring on record the Legal representatives of deceased M.Vadivel under Order 22 Rule 3 of CPC, the same is recorded. Accordingly, this petition is ordered.
