The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Section 381 IPC in Crime No.354 of 2022, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner while serving as 'Record Clerk' in the Block Educational Office, Uthangarai, he along with other accused person misappropriated the 2nd term free School books to be issued to the students studying 1st to 5th standard for the year 2021-2022. Hence the complaint

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Hence, he prays for anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor submitted that the petitioner along with other accused misappropriated free School books to be issued to the students. He would further submit that this Court already 1/3

dismissed the petitioner's earlier anticipatory bail petition vide order dated 04.08.2022 in Crl.OP.No.18395 of 2022. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.

5. It is seen that the petitioner misappropriated the School books to be issued to the students. Thereafter, the petitioner sold out the entire books to the scrap shop.

6. Considering the facts and circumstances of the case and the submissions made by both counsel and also the fact that there is no change of circumstances after the dismissal of the petitioner's earlier anticipatory bail petition, this Court is not inclined to grant anticipatory bail to the petitioner.
