This application has been filed by the applicants to appoint an Advocate Commissioner to submit Ex.P1, Ex.D7 to Ex.D9 and the original Release Deed dated 01.02.1971 for comparison to the Forensic Science Department, Chennai and consequently submit the report before this court.

2. Heard both sides.

3. The learned counsel for the respondent has submitted that he is not denying specifically the written statement. Even they have not elicit anything from the cross examination of PW1 and PW2.

4. Considering the facts and circumstances of the case and being satisfied with the reasons stated in the affidavit filed in support of this application, this application is allowed. Accordingly, this court is intended to send the relevant documents to the Forensic Science Department for comparison of signature.

5. Mrs.M.Nirmala Murugan, Advocate, Enrolment..No.1341/2006, No.9, 2nd Street, Lakshmipuram. Gandhi Road, Tambaram West, Chennai -45, (Cell No.96770 63787) is appointed as the Advocate Commissioner to submit Ex.P1, Ex.D7 to Ex.D9 https://www.mhc.tn.gov.in/judis and the original Release Deed dated 01.02.1971 for comparison to

gv the Forensic Science Department, Chennai. The initial remuneration of the Advocate Commissioner is fixed at Rs.7,000/- (Rupees Seven Thousand only) and the same shall be paid by both the parties equally and directly to the Advocate Commissioner.

6. The Advocate Commissioner is directed to handover all the documents to the Forensic Science Department for comparing the signature. After obtaining a report, she is directed to file her report before learned Additional Master on or before 18.10..2023

7. The Registry is directed to post the matter before the learned Additional Master on 19.10.2023.
