ORDER
By consent of both parties, this writ petition is taken up for final disposal
at the admission stage itself.
2. This writ petition has been filed for a direction, directing the 1st respondent to pass Order on case no. NC 641 D/ 2024 (SA.NO. 21415 / D /2022) for recommending disciplinary action against as Public Information Officer (PIO) who, without reasonable cause, persistently fails to accept applications, delays information by considering the representation dated 01.04.2025 and 17.11.2025.
3. It is the case of the petitioner that the petitioner has made a representation seeking information about appointment of third party by using his name and employment card and though the first respondent issued a direction to the PIO to furnish information, till date the same has not been furnished. Thereby, the petitioner made a complaint on 01.04.2025 to the first respondent which is pending without consideration. Hence, this writ petition.
4. The learned counsel for the first respondent submitted that appropriate action will be taken in accordance with law as per the RTI Act as against the third respondent/Public Information Officer within a reasonable time as fixed by this Court.
5. Heard both sides and perused the materials placed on record.
6. Considering the facts and circumstances of the case, this Court without going into the merits of the case directs the first respondent to consider the complaint of the petitioner dated 01.04.2025 and 17.11.2025 and pass appropriate orders on merits and in accordance with law and as per the Right to Information Act. Such exercise shall be completed within a period of six weeks from the date of receipt of a copy of this Order.
