ORDER
The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 126(2), 191(2), 191(3), 296(b), 115(2), 118(1), 351(3) of BNS, 2023 in Crime No.192 of 2025, on the file of the Inspector of Police, seeks anticipatory bail.
2. The case of the prosecution is that due to previous enmity, the Page No.1 of 4
petitioner assaulted the defacto complainant's brother using a knife causing head injury. Hence, the case.
3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submits that custodial interrogation of the petitioner is not required and sought for anticipatory bail to the petitioner. 4.The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that three previous cases are pending against the petitioner and vehemently opposed for grant of anticipatory bail to the petitioner.
5.Considering the above fact and circumstances of the case and since three previous cases are pending against the petitioner, custodial interrogation of the petitioner is required and this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed.
