ORDER

(Made by Dr.Anita Sumanth J.) This miscellaneous petition has been filed for fixing an advance date for hearing HCP No. 329 of 2026.

2. Heard Mr.G.Nirmal Krishnan for petitioner and Mr.C.R.Malarvannan, learned counsel for Government of Tamil Nadu (Criminal Side).

3. We do not see to entertain this petition as in the medical summary the attending doctors have recorded categorically that the petitioner has a peripheral vascular disease Femoropopliteal Occlusion and the remedy is a bypass which has a high risk for failure that may result in amputation of the right leg.

4. When the diagnosis was explained to the patient, he was not willing to undergo surgery, and is presently under conservative medical management. In such circumstances, and since there is nothing to indicate that the petitioner is not receiving treatment for his medical condition, we do not see any merit in this petition seeking advancement of the hearing of the matter and dismiss the same.
