Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of Writ of Mandamus, directing the respondents to consider the petitioner for admission to MBBS/BDS etc. courses within 7.5 percent seats earmarked for the students studied in the State Government Schools qualified with National Eligibility cum Entrance Test (NEET) (UG) 2025 as per the provisions of TN Act 34/2020 for the academic session 20252026, in consideration of representation submitted by the petitioner dated 19.05.2025.

ORDER

The instant Writ Petition is filed seeking for issuance of a Writ of Mandamus, directing the respondents to consider the petitioner for admission to MBBS/BDS etc., courses within 7.5 percent seats earmarked for the students studied in the State Government Schools qualified with National Eligibility cum

Entrance Test (NEET) (UG) 2025 as per the provisions of TN Act 34/2020 for the academic session 2025-2026, in consideration of representation submitted by the petitioner dated 19.05.2025.

2. Ms.M.Sneha, learned Special Counsel, takes notice for the respondents 1 and 3, Mr.G.Nanmaran, learned Special Government Pleader takes notice for the respondents 2, 4 to 6 and Mrs.S.Mythreye Chandru, learned Special Government Pleader takes notice for the 7th respondent. By consent of the parties, the main writ petition is taken up for disposal at the time of admission stage itself.

The learned Senior Counsel appearing for the petitioner would submit that the petitioner, while studying 6th standard, because of her merit under the orders of the Government, was allotted in a private listed school. Since she studied there, her rights to get reservation under 7.5% quota is deprived of. In this connection, she has sent a representation dated 19.05.2025 to the respondents.

4. At this juncture, the learned special counsel appearing for the first and third respondents fairly submitted that they would pass orders according to its

own merits within reasonable time.

5. Heard both sides and perused the materials available on record.

6. Though there is a disputed fact, in view of the submissions made by the learned counsel for the respondents 1 and 3, this Court, without going into the merits of the case, deems it appropriate to direct the first respondent to consider the petitioner's representation, dated 19.05.2025 and pass orders on its own merits and in accordance with law, within a period of three weeks from the date of receipt of a copy of this order.

7. With the above directions, this Writ Petition is disposed of. Consequently, connected Miscellaneous petition is closed. No costs. 18.06.2025 (1⁄2) : Yes/No Speaking/non-speaking order mn To
