Prayer: Writ Petition filed under Article 226 of Constitution of India, seeking for an issuance of writ of Certiorarified Mandamus, to call for the impugned order pertaining to the 5th respondent in Na.Ka.No.15967/A2/2024 dated 09.05.2025 and quash the same and direct the respondents to consider the petitioner's representation dated 17.10.2024 within a stipulated time.

ORDER

The instant writ petition has been filed challenging the order of the fifth respondent dated 09.05.2025 and consequently direct the respondents to consider the petitioner's representation dated 17.10.2024 within a stipulated time.

The case of the petitioner is that he joined the Education Department on 20.10.1982, whereas his brother / the seventh respondent joined the Education Department during the year 1997, but, by producing false certificate obtained from the Tahsildar, Vriddhachalam Taluk, as if no other family member is working in the Government employment. His brother's appointment was after the demise of his father namely

Mr.N.Kannan in the year 1989. Hence, he sent a representation to the respondents. However, without taking into any material aspects, the respondents have rejected the petitioner's representation. Against which, he preferred the present writ petition.

Learned Special Government Pleader would vehemently contend that it is the family dispute of the petitioner and moreover, the seventh respondent is retiring on 30.06.2025 and the petitioner has not agitated the same since 1997. Hence, because of long delay, they have rejected the petitioner's representation.

Heard the learned Counsel on both sides and perused the materials available on record.

While looking at the impugned order, there is a reference, even the petitioner had given no objection for the employment of the seventh respondent. Though such no objection was strongly objected by the learned Counsel for the petitioner, the fact remains that such objection emanates only during 2025 and apart from that though the petitioner contended that the

respondents had given false certificate, he did not initiate any action for all these years and only on the verge of retirement of the seventh respondent, he has given such representation. Therefore, the rejection of the petitioner's representation by the respondents on the ground of delay could not be find faulted.

In view of the same, this Court do not find any infirmity in the order impugned and the instant Writ Petition stands dismissed. No costs. Consequently, connected miscellaneous petition is closed. 25.06.2025 veda Index:Yes/No Speaking order To 1.
