This petition has been filed seeking to modify the condition imposed in para no.5(i) of the order dated 29.04.2026 passed in Crl.MP.No.7713 of 2026 in Crl.RC.No.967 of 2026 to permit the petitioner to deposit 30% of the cheque amount to the credit of STC No.704 of 2010 on the file of the Judicial Magistrate IV,Salem.
ORDER
Learned counsel appearing for the petitioner seeks modification in paragraph no.5(i) of the order dated 29.04.2026 and submitted that this Court has directed the petitioner to deposit 50% of the cheque amount. The condition 5(i) is reproduced herein as under:
"The petitioner is ordered to be enlarged on bail, on
condition that the petitioner shall deposit 50% of the cheque amount to the credit of S.T.C.No.704 of 2010 on the file of the Judicial Magistrate IV, Salem, within a period of six weeks from the date of receipt of a copy of this order''.
2.Learned counsel further submitted that due to some misrepresentation, the above order has been passed, whereas, the petitioner has already deposited 20% of the cheque amount before the trial Court on 28.04.2022 to the tune of Rs.3,15,600/- and the petitioner is now ready to deposit 30% of the balance cheque amount to the tune of Rs.4,73,400/- within a period of four weeks. Hence, he submitted that condition no.5(i) of the order dated 29.04.2026 may be modified in the interest of justice.
3.Accordingly, considering the request made by the learned counsel for the petitioner and also the fact that already 20% of the cheque amount has been deposited before the trial Court, the condition no.5(i) of the order dated 29.04.2026 is hereby modified and shall be read as under: "The petitioner is ordered to be enlarged on bail, on condition that the petitioner shall deposit 30% of the cheque amount to the credit of S.T.C.No.704 of 2010 on the file of the Judicial Magistrate IV, Salem, within a period of six weeks from the date of receipt of a copy of this order''.
4.The aforesaid condition to deposit 30% of the cheque amount shall be complied with within a period of six (6) weeks from today and the petitioner is directed to produce the deposit receipt on the next date fixed.
5. In the mean time, the respondent is directed to file the counter affidavit if he is so advised.
6.Put up this case on 29.09.2026 for final hearing before the appropriate bench.
