PRAYER:

Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus to forbear the 1st respondent from issuing copies of service records of the petitioner on the demand or written request of the 2nd respondent in his written request dated 01.07.2013. ORDER

Heard the learned counsel for the petitioner, the learned Special Government Pleader for the first respondent and the learned counsel for the second respondent.

2. This writ petition has been filed for issuance of a writ of mandamus forbearing the first respondent from issuing copies of service records of the petitioner on the demand of the second respondent.

3. The writ petitioner is the brother-in-law of the second respondent. While the petitioner was working as a Deputy Manager in the Head Office of the Tamil Nadu Ware Housing Corporation, the second respondent has sought information with regard to the service records of the petitioner. https://hcservices.ecourts.gov.in/hcservices/

4. According to the learned counsel for the petitioner, it is a personal information of the petitioner, hence as per Section 8 (d), (e), (g) and (j) of the Right to Information Act, the first respondent ought to have rejected the request of the 2nd respondent.

5. The learned counsel for the second respondent would submit that at the time of filing the application under Section 7 of the Right to Information Act, the petitioner was in service and the second respondent is also not interested to get the said information of the petitioner.

6. Recording the submission of the learned counsel for the second respondent, this writ petition is closed, as no further adjudication is required in this writ petition. No costs. Consequently, connected miscellaneous petition is closed.
