Respondents Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorari to call for the records of the Chief Judicial Magistrate at Puducherry in Cr.M.P.No.1009 of 2025 dated 24.04.2025 and the consequential notice of taking over possession by the Bank dated

03.06.2025 and to quash the same and consequently to direct the respondents 2 and 3 to permit the petitioner to pay the upfront amount of 5% on the basis of the One Time Settlement already reached between the petitioner and the Bank.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) After the petition was heard for some time, counsel sought leave of the Court to withdraw the petition, with liberty to approach the Debts Recovery Tribunal.

2. Petition is dismissed as withdrawn, with the liberty as prayed for. There shall be no order as to costs. Consequently, the interim applications also stand dismissed.

If the application is filed before the Debts Recovery Tribunal within two weeks from today, the delay, if any, shall be deemed to have been condoned.
