Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents herein to implement the 14th Wage Settlement (ghh;it.C1/23053 of 2019), signed under Section 12(3) of the I.D. Act dated 24.08.2022, and to re-calculate the retirement benefits of the petitioner such as difference amount of gratuity, leave salary, provident fund, commuted value of pension, revised pension for the period from 01.09.2019 to 22.12.2022 (date of retirement) pension arrears and other retirement benefits and consequently direct the respondents to pay the petitioner the difference amount of the same along with interest at the rate of 6% per annum within the time limit stipulated by this Court. By consent of both the learned counsel for the parties, the Writ Petition is taken up for final disposal, at the admission stage itself.

2. The instant writ petition has been filed with a prayer for issuing a Mandamus, directing the respondents herein to implement the 14th Wage Settlement (ghh;it.C1/23053 of 2019), signed under Section 12(3) of the I.D. Act dated 24.08.2022, and to re-calculate the retirement benefits of the 2/6

petitioner such as difference amount of gratuity, leave salary, provident fund, commuted value of pension, revised pension for the period from 01.09.2019 to 22.12.2022 (date of retirement) pension arrears and other retirement benefits and consequently direct the respondents to pay the petitioner the difference amount of the same along with interest at the rate of 6% per annum within the time limit stipulated by this Court.

3. Heard the learned counsel for both sides and perused the materials available on record.

The learned counsel for the petitioner would submit that the petitioner has joined in the service of the Respondents 2 and 3-Transport Corporation on 15.12.1992 and he voluntarily retired from service on 22.12.2022 as Senior Checking Inspector. The learned counsel for the petitioner would submit that he is eligible for the benefits of 14th Wage Settlement and claiming difference in pay in pursuance of 14th Wage Settlement signed under Section 12(3) of the Industrial Disputes Act, 1947, he has sent a representation on 11.03.2025 and such representation is yet to be considered by the respondents.

5. The learned Government Advocate appearing for the 1st respondent and the learned Standing Counsel appearing for the respondents 2 to 4 would submit that they would consider the petitioner's representation, within a reasonable time.

In such view of the matter, without going into the merits of the writ petition, this Court deems it appropriate to direct the respondents to consider the petitioner's representation dated 11.03.2025 and pass orders on it's own merits and in accordance with law, within a period of six weeks from the date of receipt of copy of this order.

7. With the above direction, the Writ Petition is disposed of. No costs. 24.06.2025 dm Index : Yes/No Speaking order 4/6
