(Order of the Court was made by C.V.Karthikeyan, J.) This petition has been filed seeking to condone the delay of 142 days in filing the appeal.
2.Notice had been directed and the learned counsel for R1 & R2 had entered appearance.
The learned counsel for the respondents stated that he has no objection in condoning the delay. 3.In the affidavit filed, it has been contended that the trial Court counsel did not apply for the certified copy in time and also the officer in charge was on medical leave for four months and necessary instructions could not be obtained in time and thereafter the appeal has to be prepared and filed. In the said process, there has been a delay.
4.Taking all the factors into consideration, the delay stands condoned. Registry is directed to number the appeal, if it is otherwise in order and the name of the learned counsel for the respondents may be printed in the cause list when the appeal is listed for admission.
